Enabling Technology Limited - Terms of Business and Conditions of Sale
1. Placing Your Order
Your order can be placed by telephone, fax, by e-mail or by post. Orders are accepted and governed by the following terms and conditions. No other terms and conditions except those implied by English Law shall be of any effect unless the same are expressly agreed to in writing.
2. How to Pay
Private individuals or organisations without an account with ETL are required submit payment on placement of order. This is to be received prior to any scheduling or any work being carried out by ETL. Payments can be by cheque, made payable to Enabling Technology and Training Network, or by credit/debit card by notifying us of your card details.
Official orders from local government, education and health authorities, limited companies or organisations that ETL has traded, are invoiced on terms of net 30 days, or as agreed in writing. If payment is not received within this timescale then ETL reserves the right to charge interest at 3% above base rate.
3. VAT Exemption
Many items in our catalogue are designed for disabled persons who may qualify for VAT exemption. Call for an ETL VAT Exemption Form which should accompany your order.

4. Pricing
Catalogues, product sheets and product price lists are guide prices only and subject to additional charges such as delivery, carriage, insurance and installation. If there is any variation in the price or specification prior to delivery we will inform you of these changes. Quoted prices are exclusive of VAT, which is payable by the Buyer, unless eligible for exemption.
5. Delivery Timescale
ETL will endeavour to meet / exceed our estimated delivery dates. Any delay or condition beyond our control will be notified. ETL may deliver by instalments and each delivery is deemed a separate contract until ETL deem the order is fulfilled.
6. Installation and Delivery Arrangements
ETL will endeavour to confirm arrangements for installation or site visit. If confirmation is made and the Buyer cannot take delivery, then ETL may charge for any costs incurred at the current rate at that time. If ETL cannot confirm arrangements this may cause ETL to postpone delivery. ETL are not liable for any damages or penalty for delay in despatch or delivery. On delivery, the user should arrange insurance of the equipment and is responsible for taking adequate backup and security measures of the system.
7. Training Cancellation Policy
If your appointment is cancelled with less than 72 hours’ notice, or if you do not attend, then the company reserves the right to invoice for the full cost of the training session. Please note that this will affect subsequent training sessions that you may have been allocated.
8. Title
Title to Goods remains with ETL until all monies owed by the Buyer has been received. ETL has the right to repossess or recover any Goods if payment is not made in full or on time.
9. Returns Policy
In the first instance, contact ETL to discuss returning any Goods. Returning a faulty item, contact ETL for authorisation and obtain a fault log number. The return of unwanted or inappropriate items must be returned to ETL via an insured courier within 28 days of original delivery. Returned items must be in brand new condition,(sealed) re-boxed in original packaging. Returns are subject to a re-stocking fee of up to the cost of the original postage paid, which will be deducted off your refund. Computer software cannot be returned / refunded if it has been unsealed (boxed versions) or if we have emailed you the licence information for downloadable software.
You have the right to return goods upto 28 days from the date of delivery for a full refund.
10. Claims
Shortages or damages must be notified within 3 days of delivery. The Buyer is responsible for all actions taken and in the usage of the Goods in accordance with ETL or the manufacturer’s operating instructions. ETL do not accept any responsibility for inappropriate use of the software or equipment or errors made by the Buyer. ETL do not accept any liability for items connected to or loaded onto the system by the Buyer, even if this creates a malfunction with already supplied software and hardware. It is the Buyers responsibility to perform periodic backups of their system for security purposes.
11. Software Licences
ETL will pass on all copies of the manufacturer’s terms and conditions of licences attached to the Goods supplied. ETL bears no responsibility for the terms and conditions attached to those licences. Any software systems and documentation supplied by ETL are protected by copyright laws and the Buyer, as a user of the software, has certain rights under copyright. Documentation supplied by ETL may not be copied without written authority. Failure by the Buyer to adhere to the terms and conditions of any licence could invalidate any claim made to the Seller under any warranty and could in exceptional circumstances result in criminal proceedings.
12. Your Guarantee
All Goods supplied by ETL are guaranteed by the original equipment or software manufacturer only and for the period specified. ETL will provide any and all copies of those guarantees. Unless otherwise stated, this is on a Return-to-Manufacturer basis. If the Buyer fails to adhere to the terms and conditions of usage, this will invalidate any claim made against ETL.
13. Warranty Maintenance Cover and System Support
In the event of a failure, ETL will attempt to minimise the loss of functionality of the system to the Buyer, by offering telephone liaison to the Buyer or Carer. Beyond this however, equipment maintenance, on-site visits, re-configuration work, updates or software-installation is subject to additional fees, except for separate agreed contract term exists.
ETL will provide telephone assistance to “trained users” for a period of 12 months following any training session undertaken by our trainers.
Alternatively, an ETL Support Contract can be purchased by the Buyer for the maintenance of equipment and support of ETL supplied software. The support contract is renewed yearly and optional levels of cover may be selected by the Buyer. ETL will prepare a schedule of options to be covered by the Support Contract and this will the basis of our support.
14. Exclusions of Liability
Except where provided otherwise in these conditions the company shall be under no liability of any kind however caused whether or not due to the negligence or wilful default of ETL, its servants or agents arising out of or in connection with the Goods or Services. The company shall not be liable for the loss or damage to software programs during repair or upgrade of any Goods whether or not the same are under warranty.

Complaints Procedure
ETL will respond to all written complaints within 3 working days. Please email peterh@enablingtechnology.com or call us on 01785 243111.
If for any reason we cannot resolve your complaint immediately we will advise you of how long we expect it will take and keep you fully informed throughout the process.
Privacy and other Policies
The Enabling Technology Limited is committed to protecting our client privacy and this is in line with the Data Protection Act.
